The FAA had the right to impose the new rules and procedures immediately without going through promulgation because of an emergency exemption. 2. They were able to appeal because the decision would affect the plant and its operations. However, how they could have appealed this when the dumping they were doing was indeed polluting the air and land and affecting people’s health. 3. Yes, because the FOIA provides that information contained in records of federal administrative agencies is available to citizens on proper request. 4. Yes he is bound by the regulation because Ignorance of the law is no excuse; people are expected to know the law even if it appears in an obscure federal publication such as the Federal Register. I feel bad for Mr. Merrill as I believe it is impossible for a citizen to know the whole law. 5.
