UNIT 5 ASSIGN This case shows a clear breach of contract on the part of Charlize Theron. She was paid a “substantial amount” to wear only Raymond Weil watches during a press event; but instead wore a Christian Dior watch to the event. Ms. Theron breached this contract with a unilateral mistake. Unilateral mistakes are made when one party is mistaken as to a material fact. In this case, Ms. Theron knew she was to wear only one specific brand of watch to the event, or she would be in breach of that contract. She chose not to wear the Raymond Weil watch; therefore breaching the contract with them which resulted in this lawsuit. There was another area in which the contract was breached and that is regarding misrepresentation. In this case, it appears to be misrepresentation by conduct. As stated, Ms. Theron entered into this contract knowing what was expected. When she arrived to the press event in a different watch, she breached the contract by her
