15:43 Shari’ah – path of God o Ideal system, not an achieved realized system o Movement to standardize the law in 8 th -9 th  cents to limit autonomy of rulers o Includes religious duties, matters of ethics, and religious law Only to regulate one’s external actions, not inner spirituality  o Islamic law includes Shari’ah (God’s law) and fiqh (human understanding,  interpretation, and jurisprudence) Sources of Jurisprudence (Fiqh) o Quran o Hadith o Qiyas  (use of analogy) o Ljma  (juridical consensus) – Sunni, not Shiite Interpretation often appropriates local custom as Islamic law o Taqlid – imitation, or blind acceptance of juridical precedent o Iltihad – independent reasoning by a legal expert (mufti) to issue a legal ruling  (fatwa) that could then be used by judges and litigants, to be accepted or rejected  by the community Outlawed by the Sunni Ulama, 10
