Introduction to Law (Chapter 1) What is Law? A rule Laid down by the government Enforced by the government Laws must be written down and accessible to the public to be a strong, effective law First known written law: Code of Hammurabi (Babylon, 1790 B.C.) The law provides certainty, predictability, and stability conducive to economic growth the law allows businesses and individuals to have the confidence to enter business agreements and make long-term investments Rule of Law: A nation employs the rule of law when the law is made generally and equally applicable as a general law, the most prosperous nations are the those most committed to upholding the rule of law Types of Law 1. Common vs. Civil a. Common Law i. Common law emphasizes the role of judges in interpreting and applying the law b. Civil Law i. Civil law relies much more on legislation than judicial decisions, no precedents 1. Only Louisiana uses civil law 2. Public vs. Private a. Public Law i. Matters involving the regulation of society
