JOSEPH FREDERICK “The Bong Hits for Jesus” Case DECIDED JUNE 25, 2007 FACTS OF THE CASE: On January 24, 2002, the Olympic Torch Relay was passing through Juneau, Alaska, on the way to the Winter Games in Salt Lake City. The course for the torchbearers passed along the street in front of the Juneau-Douglas High School during the school day. The Petitioner in this case, Deborah Morse, school principal, decided to allow students and staff to participate in the relay as part of a class trip. Students were allowed to leave class to watch the relay from either side of the street. Teachers and administrators monitored the students’ actions. On that day, the Respondent, Joseph Frederick, a senior at the school, was late to school. When he finally arrived, he joined several friends across the street from the school to watch the relay. As the torchbearers and camera crews passed by, Frederick and his friends unrolled a 14-foot banner with the phrase: “BONG HITS 4 JESUS.” Principal Morse, upon seeing the banner, immediately crossed the street and demanded it be taken down. Everyone complied, but Frederick. Morse took the banner and told Frederick to report to her
