AD LDSP 752 Monday, April 11,  2011 SCHOOL LAW STEVE KIRCHER ASSIGNMENT #1 BRIEF #3 – Employee Rights SUPREME COURT OF THE UNITED STATES (pending) CHARLES J. GUARNIERI, JR. v. DURYEA BOROUGH; DURYEA BOROUGH  COUNCIL FACTS OF THE CASE/BACKGROUND: This case followed the termination of Charles Guarnieri, the Chief of Police for  the Borough of Duryea.  He filed a union grievance regarding his termination, and the  arbitrator in the case ordered his reinstatement.  When he returned to work, the Borough  issued eleven directives regarding what he could and could not do on the job.  Guarneri  filed another grievance regarding the directives and an arbitrator again ordered the  Borough to modify or eliminate them. Other disputes arose between Guarnieri and the Borough, including a dispute  regarding health insurance and overtime.  Guarnieri sued the Borough, claiming that the  Borough’s actions constituted unconstitutional retaliation for his grievances. The original case was tried by a jury, which ruled in favor of Guarnieri.  The  Borough then appealed to the Third Circuit Court of Appeals, arguing that the First
