Chapter 11: Union Grievance-Arbitration Procedures pp. 283-305 Coopertools and UAW, Local 1774 Grievance Procedure Step 1: Employee, accompanied by department Steward, presents grievance to their Unit Leader. (Written answer by management) Step 2: Meeting involving: the Department Unit Leader, designated company representatives, the District Steward, Chief Steward, and employee if desired. (Written answer by management) Step 3: Meeting involving: the Plant Manager or representative, the Department Unit Leader, the (union) Negotiating Committee, the International Union (UAW) Area Director or representative, and the employee if desired. (Written answer by management) Step 4: Arbitration by an arbitrator selected from American Arbitration Association lists. (Binding decision by arbitrator) Features of Union Grievance Procedures Grievances must be based on the contract. Union carriage of grievances o The union represents the employee. o The union not the individual employee decides whether to appeal the grievance! Duty of fair representation o The union can’t refuse to file a grievance arbitrarily or due to personal hostility to the grievant, or use bad faith. Work now, grieve later Labor Arbitration Characteristics Arbitrators are chosen by the parties: o Often selected from lists supplied by FMCS or AAA through alternately striking names. o May also have standing arbitration panels. Arbitrators are paid by the parties. o Usually 50/50 split of fees or else loser pays. o Typical fees around $4,000 ($1,000/day). Who are the arbitrators?
