The Supreme Court decided several questions all relating to IXCs entering the local service market. All the questions revolved around whether the FCC or the PUCs have authority to set rules for this local competition. Previously, the 8 th Circuit: Ruled the FCC lacks the authority to adopt rules for states to use to set prices for services and network elements that incumbent local telephone companies are required to provide to new entrants. Invalidated the FCC's regulation allowing new entrants in the local phone market to obtain and use existing combinations of network elements from incumbent LECs, precluding those elements from being broken apart. Invalidated the "pick and choose" rule, which allows new entrants to select provisions of other negotiated agreements to establish their own service. 2. How did this issue impact the 1996 Telecommunications Act? The FCC was forced to revise the standards set forth in the 1996 Act for UNE, line sharing and entrance into the local service market.
