MEDICATION ERRORS 2 Legal Issues Facing Nursing Medical errors are a familiar and significant issue in today’s health care field. Medical errors take place when the medical professional, or health care organization, neglects to perform a critical act or when an erroneous action is made. Regardless of the circumstance, be it commission or omission, medical errors remain a threat to patient safety in health care facilities and need to be addressed head on. Addressing these issues will help to prevent the aftermath resulting in possible lawsuits, against practitioners and hospitals, along with preventing possible loss of life. This essay will review a case study on medication errors and the legal issues ensued, as a result of them. It will analyze the possible legal issues involved, risk mitigation measures, and actions that will improve health care results. Summary of Legal Issues The main legal issues in the case study focus on the actions of a nurse in an Intensive Care Unit (ICU), the hospital, and other medical staff in the hospital. In the wake of a patient death, the family members filed a claim for $3,000,000 in reparation for the loss of a loved one and damages caused by the medical staff and hospital. The family contended that the death of their loved one was caused by medical negligence exercised by the attending physician, the hospital, and three registered nurses.
