Describe and discuss the three most important legal issues in human resources management. What will you do as a manager about the three issues’ respective importance? First there is the Fair Labor Standards Act. This was passed in 1938 in the response to the high unemployment rate in the Great Depression. It sets the minimum wages, time and a half, guaranteed overtime, maximum overtime pay, and prohibition of employing minors. Next, there is the National Labor Relations Act of 1935. This was to govern management-labor relationships of businesses engaged in interstate commerce. It defines unfair labor practices for employees and employers, and authorizes the National Relations Labor Board to conduct secret elections for employees to determine any representation by a labor organization, and authorizes the NLRB to investigate and conduct hearings for complaints about unfair labor practices.
