Exam 3 essay question model answers 1. Ann promises to pay her cousin Bert, who is dangerously obese, $10,000 if Bert loses 100 pounds within the next two years. Bert agrees, performs his part of the bargain, and asks for the money. Ann refuses to pay, saying that she forgot about the deal, but that even if she did make such a pledge, there was no valid consideration for it. Bert files a suit against Ann. In whose favor is the court likely to rule, and why? ANSWER: A court is most likely to rule against Ann and in favor of Bert. Bert provided legally sufficient consideration by losing 100 pounds in weight over the stipulated two-year period. Generally, a waiver of a legal right—in this case, the right to eat to obesity—at the request of another party is sufficient consideration to support a promise. The promise in this question was the payment of $10,000. It does not matter whether the performance—the loss of weight—also benefited the Bert. 2.
