The infancy doctrine is a doctrine that allows minors to cancel or disaffirm most contracts they enter into with an adult. Minor refers to those under the age of majority, typically 18 years of age. 2. Define legal insanity and intoxication and explain how they affect contractual capacity. Legal insanity is a state of incapacity which affects a persons ability to make proper judgments when entering into a contractual agreement. They may not fully understand the consequences of their actions when entering into the agreement. Intoxication refers to the state of a person who is under contractual incapacity due to the consumption of alcohol or drugs to the point of being incompetent.
