There are three parties involved, the mother, the father, and the five-year-old son. The rights that are at stake is the mother being allowed to smoke around her five-year-old son. The court took away her right to smoke around him because the father claimed that breathing secondhand smoke could harm the boy's health. So, the judge used a moral consideration to rule in the father's favor and took away the mother’s right.
