4 types of intellectual property - Patents – protection of idea - Copyrights- protection of embodiment of ideas - Trade secrets – protect both idea or embodiment of idea - Trademarks – protect the consumer against profitable marketing, and brand names and logos Patents - Three ptypes of patents in the US o Utility Patent – new/useful method, process, machine, device, manufactured item or chemical compound o Design patent – ornamental design of a functional item o Plant patent – a new variety of a plant - Invention must be o New – has not been taught before, US is not first to file – patent examiner will search through domain of patents o Useful – very low threshold, does not have to be very useful o Non obvious - cannot be an obvious improvement on an invention that has been taught before – make an novel improvement to prior invention - Hot topics/recent events in patent law o Software/business method patents o Patent trolls/non practicing entities o Abbreviated new drug application litigation – generic vs. brand name pharmaceuticals Copyrights
