To : Congressman Michael Grimm From: Eric Rodriguez Regarding: The admission of immigrants with HIV entering the United States of America regardless of their country or origin. Introduction: This Policy Memorandum implements the mandate of The Immigration Screening Act. If passed, this will require all incoming immigration to be denied access of citizenship/visa eligibility if found with any of the communicable diseases of public health significance (including HIV) as listed by the CDC. I recommend that you support this bill, as it will prove to be beneficial to not only our state, but our country as well. Background: The Department of Health and Human Services and Centers for Disease Control and Prevention (CDC) have removed HIV (human immunodeficiency virus) infection from the definition of communicable disease of public health significance. “By law, non-U.S. citizens (known as aliens) who are determined to have a communicable disease of public health significance, a mental health disorder with associated harmful behavior, or drug abuse/addiction are inadmissible to the United States. Aliens wishing to live in the United States permanently are also screened for these medical conditions to determine whether a permanent resident visa will be granted” (Center for Disease, 2010). Prior to the effective date of January 4, 2010, HIV was among the diseases that could prevent people who are not U.S. citizens from entering the country. However, due to new legislation, the CDC has removed all references to HIV infection in these regulations. In essence, these aliens will be tested for HIV however, if they are found positive they wont be deterred from entering our country. This proposes new problems to our
