Darius Owens B3 The Supreme Court under the Earl Warren Court used judicial activism by declaring prayer in public schools unconstitutional with the Engle v. Vitale and requiring police officials to inform suspected criminals that they have the right to an attorney and protection against self- incrimination with Miranda v. Arizona . The recent high court decisions have modified Engle v. Vitale with Elk Grove Unified School District v. Newdow , when it was claimed that monotheistic beliefs were unconstitutionally promoted with “under God” in the Pledge of Allegiance. This appellate decision was declared was null and void due to the plaintiff not being the custodial parent of his daughter. In the Bill of Rights, the 5 th Amendment protects the American people from a tyrannical federal government. The 14 th Amendment extended that protection to people from the states. With Miranda v. Arizona, the Supreme Court used the 5 th and 14 th Amendment by requiring local, state, and federal law officials to inform suspects the protections they have while being detained. With Engle v. Vitale, the Supreme Court used the 1 st (Freedom of Religion) and 14 th Amendment and declared that state officials requiring prayer in public schools conflicted with separation of church and state originally declared in our nation, thus using judicial restraint.

Darius Owens B3 Since the Great Depression, the power of the Federal Government has been expanding at the expense of the states’. They have expanded with categorical grants because the money given to states must be spent how the federal government wants and needs it to be invested in. Mandates, given by the President following inauguration, lay out his political agenda for the entire nation, in which everybody, including the states, will end up moving towards no matter what. With United States v. Lopez , the Supreme Court has attempted to restrain Congress’ commerce power when they questioned the constitutionality of the Gun-Free School Zones Act of 1990, which made it a crime to own a firearm within 1000 feet of a school. In the end, this was the first Supreme Court case since the New Deal to set limits to Congress’ Commerce control powers.
