Summer Phillips Lex 280 – 01 NC Rules of Professional Conduct matched with Books IV, V, and VI Activity 1. Client – Lawyer Relationship: Rule 1.3 – Diligence . - “A lawyer shall act with reasonable diligence and promptness in representing a client.” - The means a lawyer must be committed to pursuing the best interests of their client. They must be dedicated and zealously advocate for their client’s case. However, this rule also states that, “a lawyer is not bound to press for every advantage that might be realized for a client” (i.e. a lawyer may have authority to exercise professional discretion in determining the means by which a matter should be pursued). The maxim I chose to pair with this rule is from Book V: Justice – Maxim vi.: A note on injustice in the wider sense of wrongdoing. Aristotle states, “For justice is only found among those whose mutual relations are controlled by law, and law is only found among those who are liable to injustice; for legal justice consists in distinguishing between what is just and what is unjust”. Rule 1.3 discusses what actions taken by an attorney constitute Professional Negligence. An attorney’s act may be considered professional malpractice but, may not necessarily constitute a violation of the ethical duty to diligently represent a client. 2. Public Service: Rule 6.1 – Voluntary Pro Bono Publico Service. - “Every lawyer has a professional responsibility to provide legal services to those unable to pay.” – Every lawyer has a responsibility to provide pro bono legal services, and The NC State Bar recommends a minimum of 50 hours each year.
