Summer Phillips Lex 110 – Hy Module 2 Activity 1. This case was against a Colorado attorney, Franklin Azar who was famous for his TV advertisements, for negligence and misrepresentation. Shawna Jiminez, plaintiff in the case, stated that on the Azar’s commercials he boasts about how he can get the most money from the insurance companies. Jiminez was represented by Nancy Fisher from the Azar firm and said she was pressured to take a $25,000 settlement for a car accident, and she was duped by the commercials. Her attorney said the Azar firm was not about the client’s best interest, but instead about turning settlements quickly and frequently. The Azar firm and Fisher were found guilty of professional negligence, Fisher was also found guilty of breaching her fiduciary responsibility, and the firm was also found guilty of negligent misrepresentation.
