Nammi K. Kirsten G. Statutory rape: Recently, a 17-year-old boy was sentenced to 10 years in prison for having consensual oral sex with a 15-year-old girl. Are statutory rape laws patronizing to girls and discriminatory to boys? Stages of critical thinking in the research process. PART I: Thinking Critically About Your Topic (10 minutes): 1. What is your visceral reaction to this question? Why? Surprised considering an age difference of only two years and both parties are under the age of consent. This penalty seems pretty harsh. This seems to be a good question to open up discussion about the topic. 2. How may we think about this question differently? We could approach it mainly answering the discriminatory aspect or we could approach the general situation such as the teenagers’ ages and the relationship between the two. We could consider not just their ages but where they are in their lives, ex: a sexual relationship between a college kid and a high school kid is more disturbing than a relationship between a high school senior and sophomore. 3. What are some of the underlying assumptions in the current law about children/parents/right to make decisions? Assumes that children do not have the capacity to make decisions and that the parents will act in the best interests of the child and are more capable of making decisions. Also, even though they are both underage, they assume it was the boy's fault (whether this is because he is older or a male is unclear). 4. At what point is one considered an adult and how? We tend to consider someone and adult when they learn how to take responsibilities for their actions and can live with the consequences. However, the legal system cannot afford to be so subjective, it recognizes a person as an adult via age. 5. Does age indicate maturity? No, many people in college aren’t as mature as some in high school. indicate maturity. Some people mature faster than others and maturity can only be determined by experience and emotional capacity to handle those experiences. It all depends on the individual. 6.
