Unit 4 Case Study 2 Carrie has a set of legal encyclopedias to sell. She offers to sell the encyclopedias to Antonio for $300.00. Antonio did not accept her offer but told her he would give her his decision the next day. Carrie does not disagree with this counteroffer of acceptance. Overhearing the conversation between Carrie and Antonio, Norvel tells Carrie that he accepts her offer. Carrie sells the encyclopedias to Norvel, even though she has an agreement to wait until the next day to wait for a decision by Antonio. The next day Antonio accepts her offer but Carrie has already sold the encyclopedias to Norvel. Any competent person can accept an offer and enter into a contract, even minors. If a person is deemed to be mentally incompetent the contract cannot be legally binding and therefore cannot be bound by the contract terms.
