Unit 5 Case Study 2 When a party is in found to breach of contract it is because of the nonperformance of a contractual duty (Jentz, G. A., & Miller, R. L., 2008 p. 233). A material breach allows the non-breaching party to sue for damages. The plaintiff in this suit is suing on the grounds that the defendant breached the contract by wearing a watch that was not made by the plaintiff. There is physical evidence of this act, a photograph of Charlize wearing the watch, and it is written in the agreement that she is only to wear the plaintiff’s watches. Raymond Weil is suing Charlize Theron for wearing a Christian Dior watch while being contracted to only wear Weil watches exclusively from October 2005 to December 2006. Charlize was paid substantial funds to model in the Weil’s company ad campaign. Charlize was also the face of Dior perfume at the same time she had entered in to the contract with Weil.
