We know that Ellen finds out that her likeness has been used, and she sues the CC for misappropriation. In order to discuss the cause of action in this case, let’s start with the definition of misappropriation. According to M. Jennings, “misappropriation is conversion of a trade secret, such as a customer list, a proposed marketing plan, or new strategy to personal use, including use for self-benefit or a benefit of a new employer.” A good example would be a situation when someone who is very similar to Arnold Schwarzenegger is advertising protein supplements for bodybuilders on the commercial and says that he has won a bodybuilding world championship seven times in a row. Then people might think that the man on the commercial was Arnold Schwarzenegger, in fact it was someone else. It seems that in our case we have to deal with an invasion of privacy.
