In order to determine whether an individual will recover from the injuries, there are five major aspects that have to be taken into consideration before the final decision will be made plus 3 elements of defense. The first element is called “the duty to act like an ordinary and reasonably prudent person”. For example, For example, a landowner owes duties to people who enter their property. In other words, we citizens should act like ordinary and prudent persons. In our case, GM sent their employee to Arizona on a business trip at their sole request. Except sending him, they should have taken care of the employee’s safety. Why? Because, it was the General motors’ who sent an individual and he was hired buy them, so he had a right to work in a safe environment. They should have informed him to wear a mask so that he could be protected against the dust which was the real cause of Valley fever. Secondly, next important element that has to be analyzed is called the “breach of duty”. It means that somebody who is a professional, for example a translator, should offer his or her services in compliance with the rules established by American Association of Translators i.e. ATA. It means that every company, person or an institution has the duty of practicing their professions of a level of a reasonable professional. Otherwise, failure to comply with these rules would be a breach of duty. However, in our case, the GM’s mandatory duty is as follows: “Every business should be concerned with the health and safety of employees, even when staff is not exposed to heavy machinery.” “If a business is negligent in their obligations to provide employees with a safe working environment, the risk of accident and injury is increased. If a worker becomes injured, there is a risk that he or she can claim compensation from the company, which can become very costly. The reputation of the business can also be irreparably damaged, causing a loss of clients.” Thirdly, another element which identifies the cause of the damages is called “causation
