EMC Confronts Harassment Charges 2 EMC Confronts Harassment Charges Introduction Sexual harassment and sexual discrimination are serious issues of the workplace. They must be addressed in a manner that protects the victims as well as the reputation and image of the organization. Addressing such matters is also an opportunity to educate employees that may be misinformed or completely uneducated in such matters. Review/Analysis of the Case Noe, Hollenbeck, Gerhart, and Wright describe sexual harassment through the definition of the EEOC. “Unwelcome sexual advances, requests for sexual favors, and other verbal or physical contact of a sexual nature constitute sexual harassment when 1. Submission to such conduct is made either explicitly or implicitly a term or condition of an individual’s employment, 2. Submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual, or 3. Such conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile, or offensive working environment.
