How can you tell when a lawyer is lying? His lips are moving 4Business Law (FIN 3055) week 1: Law defined: set of rules or laws the govern us Laws provide us with continuity and stability along with predictability The three theories of law: Legal positivism-must obey a law even if it’s not fair Natural Law- Aristotle. Legal Realism- law cannot be applied uniformly School of thought the judge has influences his verdicts The rules that govern society come from: Egypt-12 books of recorded law evolved into Sumerians (If…then…) then Hammurabi Code-stone placard then Ancient Athens (Rome) Roman law and was based on theory (very expansive) and put together corpus civilis and made civil code (peoples code) BGB-model civil code because Germany came to power Napoleany code of France-(Louisiana) Common law comes from age old England Courts of law and courts of equity (chancery courts-part who does not seek monetary remedy but some form of equity or rule [can or cant do]) We are a common law country based of judge made law Stare Decisis- must follow precedent Civil code countries- no jury, no disputes over evidence, just go to the book Common law countries-more difficult to figure out the law, Constitution-supreme law of the land. Nothing can conflict w/ US constitution Administrative law- rules, orders Stare Decisis- do not overturn a case Statute is created? – bill > law Civil law- plaintiff v. defendant criminal-usually not financial remedy
