371 Revista de Estudios Histórico-Jurídicos [Sección Historia del Pensamiento Jurídico y Político] XXXI (Valparaíso, Chile, 2009) [pp. 371 - 397] A BSTRACT This research deals with the develop- ment of the Spanish doctrine on the State in the 17 th century and the formulation of a discourse about the monarchy, the empire, war and peace. The context in which such Spanish doctrine is formulated is organized as from the international conflict of the Thirty Years’ War, which will have a dual nature for Spain: confessional and of world- wide political domain; a European internal context, considering Spain’s European possessions, which will be characterized by the uprising and resistance to the Spanish domain: the Netherlands, Catalonia, which obliges Spain to be involved in a permanent war, which lasts for more than 140 years. In the external context, object of this study, the ideological conflict during the Thirty Years’ War (1618-1648): Monarchy, State and Empire. K EYWORDS : Spanish-Catholic doctrine of the modern State – Empire – War – Peace. R ESUMEN La presente investigación trata del desarrollo de la doctrina española del siglo XVII sobre el Estado y la formulación de un discurso sobre la monarquía, el imperio, la guerra y la paz. El contexto en el cual se formula tal doctrina española está estructu- rado a partir del conflicto internacional de la Guerra de los Treinta Años, la que para España tendrá un carácter dual: confesional y de dominio político mundial; un contexto interno, europeo, considerando las posesio- nes europeas de España, que se caracterizará por la rebelión y la resistencia al dominio español: Países Bajos, Cataluña, lo que obliga a España a una guerra permanente que se prolonga por más de 140 años. En el contexto exterior, objeto de este estudio, el conflicto ideológico en el curso de la Guerra de los Treinta Años (1618-1648): Monarquía, Estado e Imperio.
