THE JUDICIARY Federalist #28 Hamilton argued that the judiciary would be the least dangerous branch of the three. - NO wars, or NO laws just thinking about right or wrong Little Rock 157- 1959: - Separate and unequal in the school system - School District beginning with Brown process where they mixed black and white o Not everyone like it and politicians responded (governors) spoke that we don’t have to integrate and I’m not placing my school to this o Eisenhower sent the US army 10000 to make sure that the school WAS integrated. o DID NOT MAKE IT EASY AND YEAR OF ABUSE o Governors new idea was to close down all public schools o JUDICIARY declared unconstitutional This was not the only case, took around 7 year to integrate The Constitution and the National Judiciary - Article III of the Constitution establishes o A supreme court in which the judicial power of the US is vested o The original jurisdiction of the Supreme Court o Such inferior courts as Congress may establish o Life tenure for judges
