Page 1 of 2 BU206 Assignment 1 Kevin Culley 1. In this case Jonas filled a lawsuit against Nancy for disturbing the peace, for example: noise ordnance for the apartment building or county. Jonas wants an injunction to have Nancy stop playing her tuba. The case will go in front of a judge for a determination for both sides. There can be three outcomes: let the tuba play, stop all tuba playing or limit the time during certain periods you can play the tuba in the apartment building. Jonas seems pretty upset and would rather have the tuba gone but she might settle on time limitations. No body wants to hear a tuba at three in the morning. a. (Chapter 1) Every night at 11PM, Nancy plays her tuba. Jonas, who lives in an apartment across the hall, couldn’t stand it anymore, so he filed suit. What remedy did Jonas likely seek? Briefly explain why (hint: read chapter 1 material on remedies). 2. The assumed law that Arabic citizens need a special passport to travel would fall under the Fifth Amendment. The due process clause under this Amendment would mean that the “government must treat similar individuals in a similar manner.” The assumed passport law limits the liberty of Arabic citizens only from traveling.
