ADM 3360 A Kevin Spence 4476793 Chapter 5: Case 6 There is a good chance that McKnight’s action against Chang for breach of contract will be successful. This is because there was a contract in effect between McKnight and Chang, and Chang went ahead and Chang accepted an offer from a third party and sold his land to this person. Although Chang was not aware that there was a contract in place between him and McKnight, he is still bound to the contract that was made since the mode of acceptance used was mail. Chang did not specify the mode of acceptance that McKnight was to use, so McKnight decided to use the mail to return a letter of acceptance to Chang. When acceptance by mail is used, “acceptance is complete when a properly addressed and stamped letter of acceptance is dropped in the mail” 1 . McKnight had instructed her lawyer to write up an acceptance letter and send it to Chang. McKnight’s lawyer did so and placed the letter in the mail at 10:00 am on July 7.
