ADM 3360 A Kevin Spence 4476793 Chapter 22: Case 6 Kopikat Inc will only have infringed on Dolphin Marine Ltd if Dolphin provided the design of the new hull and its features to the public by filing a description of the design so other manufacturers will be able to duplicate it when the statutory period of Dolphin’s monopoly has expired 1 . If Dolphin did go through this process of filing its new hull design and obtained a patent for it, then Kopikat has infringed on Dolphin as Kopikat constructed a direct mould of Dolphin’s hull and produced a boat with a hull that was identical to Dolphin’s that also had other features that were very similar as well. If Dolphin does have the design of the new hull registered as a patent, then that means that Dolphin has the “exclusive right, privilege and liberty of making, constructing and using the invention and selling it to others to be used” 2 . As a result of Kopikat producing a mould of Dolphin’s hull and constructing a boat that has an identical hull to Dolphin’s, Kopikat has violated and infringed on Dolphins’ rights.
