Income Tax I Name __Christian Yimgnia_____ Chapter 2 Questions Explain and/or discuss the following based on reading the chapter and viewing the power points. Be thorough with your answers. You may take all the space you need. 1. Describe the statutory authority of the tax code. The statutory authority is the Internal Revenue Code, the US constitution and the tax treaties. For example when the government raises revenue through a federal income tax is a US constitution law. The Internal Revenue Code is where the tax law is written and contains most of the tax rules. There are also tax treaties that can be applied when dealing with taxes. For example if The US has a tax treaty with Japan about not paying taxes within each countries, then a Japanese living in the USA will be refunded on all taxes he was charged. 2. Describe the administrative authority under the tax code. The administrative authority states that the secretary of the treasury should set all necessary rules for and regulations for the enforcement of the internal revenue code, including rules and regulations that can be needed in case the internal revenues law changes. 3. Describe the judicial authority as the basis for tax law. Judicial authority is in place to interpret the code and determine the validity of regulations and apply the law to the facts of a given case taking place in the courts. For example if a tax payer appeals doesn’t feel like he owes tax money to the IRS, he can take it to court and appeal rulings from IRS. 4. Describe the rules for persons representing taxpayers before the IRS, including who may represent individuals, corporations, etc. The main persons representing taxpayers before the IRS are attorneys, CPAs and enrolled
