Cameron Hartman 11/03/09 Seat # 59 ARROWHEAD SCHOOL DISTRICT NO. 75, PARK COUNTY, MONTANA, v. JAMES A.  KLYAP, JR. Facts: In 1997, Arrowhead School District No. 75 (School) hired James Klyap (Klyap) as a  teacher for the following school year.  Klyap taught three subjects to three different grades, and  he also initiated a sports program for the school. On June 30, 1998, the School and Klyap  agreed to a contract in regards to the following school year. The contract provided terms  regarding his salary and included a liquidated damages clause. This clause expressed the  amount of liquidated damages that would ensue under a breach of contract (20 percent if  breached after July 20, 1998). After signing the previously stated contract, Klyap signed a notice  indicating familiarization with the teacher handbook, which noted the liquidated damages  clause. On August 12, which was shortly before classes started, Klyap resigned from the
