8/24 14 th Amendment     Prohibit national religion     Before the 14 th amendment: state constitution could allow official state religion 1 st amendment didn’t have to be applied 1868: Federal Constitution only binding on federal matters     After 14 th amendment Overturns Dred Scott Case that said blacks couldn’t be citizens of US 14 th amendment changes to deal with citizenship Born in US = Citizen No longer treating slaves/former slaves as non-persons     Before: dual citizenship of state and federal     After amendment: everyone has same rights in the US     1920s: 14 th amendment applied to other rights Gitlow v. New York (pg. 36) All citizens wherever they live is protected by the 1 st amendment and the state cannot deny this right Federal constitution established a floor of uniform rights but not a ceiling so states may confer more protection but not less Bill of Rights aimed at federal not state If we amended the 1 st amendment 4
