Merrel Dow Surrogates In re Quinlan case (p 558) - a woman who agrees to become pregnant and give the baby away may have done it for reasons relating to money - Unfair contract – society should not enforce it - Most states permit the woman being able to change her mind - Questions of death – when is a person / baby dead o Respirators, feeding tubes, breathing tubes – commas are limitlessly possible Father wants to pull the plug p 557 - Doctors said there was no hope, no reason to keep her in a vegetative state - Doctors are supposed to save human life – this is part of their oath – but doctors do make the distinction between trying to take care of someone and knowing there is nothing else they can do - Extraordinary measures Baby Doe – baby who is severely compromised – terrible medical circumstances - physically or mentally retarded, broken limbs – should the government interfere or is it the decision of the parent - Lives worth living (Nazi talk?) Cruzan by Cruzan (558) - Uses 14 th amendment due process clause and right to life, liberty, and pursuit of happiness - Advanced directives – sign a living will that means that the doctors would not have to take extraordinary measures to keep you alive - Right to die – are you allowed to commit suicide – is this the same as suicide if you do not want help o If you sign a contract that says you want to die before any circumstances, this is not suicide
