Community Policing and Police Discretion; The Impact of the COPS Federal Grants. READ Chapter 9 in Critical Issues September 8, 2011 Mala Prohibita- wrong because prohibited UCR- (uniform crime report) measures those crimes that are recorded to the police - part I crimes--reported but arrest does not have to be made...murder, aggravated assault, robbery, rape, burglary (requires a human being/home...your house cannot be robbed, its burglarized) , theft, auto theft, arson - part II crimes--arrest has to be made (guns, drugs) NCVS- (National Crime Victimization Survey) attempts to get a better picture of the unreported crimes UCR is more accurate than NCVS Monetary Costs- can be estimated by identifying the criminal justice system operating and offender processing costs Human Costs- refers to the lost lives and unused human potential 3 sources of error in the UCR:- Hierarchy Rule- where if multiple crimes are committed in a single incident ONLY the most serious crime is reported to the UCR- Inconsistency in data submission (UNDERREPORTING)- Clerical and Date processing problems (BOTH UNDER AND OVER REPORTING) Problems with NCVS:- it cannot measure all crimes Postal Inspectors is oldest thing (1774..before America was even here) Sept. 12, 2011 1st. Amend = speech, religion 4th Amend = arrest, search, seizure 5th Amend = self incrimination, double jeopardy - Inquisitive- whats your name? (general stuff)- Accusative- did you murder that guy? (speciFc stuff that may be related to a crime) 6th Amend = right to counsel, speedy trial 8th Amend = cruel and unusual punishment 1st amend - bill of rights - Frst 10 amendments to the constitution that protects individuals from unwarranted intrusion into their daily lives- Government is only thing that has so much power over us - Constitution set up frame work for majority representative gov - US supreme court has held virtually all speech to be constitutionally protected, except pornographic/dangerous speech - Speech and religion 4th amend - retrains the police - Must have probably cause to arrest/warrant to search - Probably cause = something more than mere suspicion and permissible thoroughness...
