Did the Pahler court use the same reasoning as used in Bailey v. Eminem ? Both courts used the First Amendment as the final ruling for each case, being the plaintiffs could not hold the defendants responsible for their artistic expressions. In the Pahler case, the parents sued the band, Slayer , saying they were partially responsible for the crime ( Rock ‘n roll murder: When lyrics lead to violence. , n.d.). In the case of Bailey v. Eminem, the plaintiff accused the famed rap-star of thwarting his possible music career (Rogers, S., 2012). The First Amendment protects artists typically from these claims ( Rock ‘n roll murder: When lyrics lead to violence. , n.d.). Should the court’s decision in Pahler be different because a young girl was murdered? In a common law trial, the judge has the flexibility “to change, adapt, and mold the law to fit particular cases to ensure that justice is done and that the law reflects society's changing social values” (Rogers, S., 2012). Both cases should be tried in the same manner, and although one case is horrific, neither artist should liable for said outcomes.
