CRJ 306-week 4 Discussion Explain the plea-bargaining process. In plea bargaining, a defendant is faced with a charge at arraignment. Typically, this is the maximum charge or punishment that the defendant will be held to if he or she goes to trial. The prosecutors will present the defendant with an opportunity to plead guilty to a lesser charge or to the original charge with less than the maximum sentence (Devers 2011). List the elements of a valid plea bargain. All the Court requires for a guilty plea and a simultaneous waiver of rights is that the plea is voluntary, intelligent and has a factual basis (Wan 2007). Define the role of a judge in the plea-bargaining process. The judges may have to pressure the lawyers to work there cases out so they would be able to take the case or cases off there calander. Judges can reject a plea bargain offer because they have the power to do so.
