Case #3: Roe v. Wade FACTS: “the 1973 case that held that a woman’s right to privacy protected her decision to have an abortion”(Canon 612). There was an argument against the state that abortion should be legalized because a woman has privacy rights over her body. ISSUE: “ Should the Supreme Court be able to prohibit the states not only from violation the express guarantees contained in the Bill of Rights, but its implied guarantees as well?”(Canon 612). DECISION: If the state wants to protect the life of a fetus after viability, the furthest it can go is to prescribe abortion throughout that time period except when it is necessary to preserve the life or health of the mother. The Supreme Court allowed her to terminate the pregnancy because it was a privacy issue. CONFLICT: The state’s argument- “Texas law prohibited abortions except for ‘the purpose of saving the life of the mother.’”(Canon 612). The nation’s argument- “The
