Chapter 2 Review Questions Why is the commerce clause so important in the business world? The commerce clause gives the government power to regulate any business that is involved in commerce in more than one state. It is almost impossible to completely isolate a business from interstate commerce, and even if you think you may be isolated you are not. It gives the federal government immense power in regulating business. What are the three major events that determined the division of power struggle between the national and state governments? McCulloch v. Maryland – established the implied powers. Maryland tried to tax a bank owned by the federal government and sued them for refusing. American civil war – states didn’t want the federal government to regulate their slavery Civil Rights Movement – Jim Crow laws, white primaries, Plessy v. ferguson, brown v board. What is the concept of judicial review? How is it established? Judicial review is the power of the supreme court to declare an act of congress or the president unconstitutional. Supreme court assumed the power because of the case of Marbury v. Madison.
