Gun Free School Zones Act- Can not carry gun on school property. Lopez was caught on a public grade school campus in San Antonio with a gun in his pocket. Chose to prosecute him under federal law… convicted and sent to federal prison… appealed conviction was unlawful b/c law was unconstitutional. School was not business but the courts said it was… not engaged in business activity but he was interfering with it, however courts declared law unconstitutional and Lopez walked. Cant use commerce clause to interfere in people’s lives only business related interferences. Supremacy Clause • Oklahoma vs Hughes… Hughes wants to smuggle his own fishing bait into Oklahoma who said you had to use their own bait. Not known for fish or fishing and does not support their economy. Could not justify their law so law was declared unconstitutional • Maine vs Taylor…. Maine said you could not bring own bait into Maine.. Maine vs Taylor…....
