Lecture 4 14:26 Searches Warrantless searches  o Plain view o Probable cause Warrants needed o Criminal cases not always civil cases o Need to have evidence and go to court to get a warrant Exclusionary rule o If police obtain evidence illegally then all that evidence is excluded from  trial Fruit of the poisonous tree doctrine o If illegally seized evidence leads to other illegal evidence it is also  excluded Easy to get out of illegal evidence 5 th  amendment  o business/ civil cases cant take the 5 th  amendment o very limited in criminal cases also o Due Process means the law has to give a fair chance… have to be treated  fairly. Can not take you life liberty and property with out a fair shake…  sliding scale based on what they are trying to take from you o Imminent domain- can take your property if they prove that they need it but
