The re-development plan will not only create new jobs, it will also produce property tax revenues if property is being bought or taken. The number of new jobs is expected to be between 1,736 and 3,196. The tax revenues to be produced are supposed to at least be $680,544. B. What happened when a few homeowners decided not to sell? For the few homeowners that decided not to sell, the city initiated condemnation proceedings, which allowed the city to take their property. C. A group of property owners fought the city’s action in court. What did they argue? The citizens thought that the government ruling that allowed them to take some properties and not others violated the 5 th Amendment’s Taking Clause. D. When are takings allowed under the US Constitution? The US Constitution says the town can take the land if they land will serve for public purpose. E. What did the Supreme Court rule in regards to economic development? What precedent did the Court cite in making this ruling? The Supreme Court ruled in favor of the economic development. The Court believed the plan did serve a public purpose, and the public use requirement of the Fifth Amendment was satisfied.
