Inquisitorial process – Judge controls by asking questions of the  lawyers Limited role for juries. Limited rights for defendants. Dominant system in Western Europe. System found in Italy,  France, Spain, Germany, Japan and many other countries.

6 6 International Legal Environment of  Business Shari’a  – Islamic law . Based on the teachings of the Koran, the Prophet  Mohammed and the writings of Islamic scholars. Evolution of Islamic law is frozen – the door of  ijtihad  (independent  legal reasoning) closed in the 10th century AD Shari’a  is primarily a moral code – concerns family matters more than  commerce and international relations.  1.3B Muslims in the world Different views in Islamic nations. Strict – Saudi Arabia; More moderate - Turkey In many Muslim countries such as Egypt,  Shari’a  is relied upon for family  matters.  Western secular law is relied upon for other matters.
