Joshua Wexler Mr. Handley Introduction to Law – A December 7 th , 2008 The Death Penalty When you wrongfully fine someone, you can give them a refund, when you wrongfully jail someone, you can let them out, but when you wrongfully take away someone’s life, you can never give it back. Because taking a life is an irreversible decision, people given the death penalty must be without a doubt guilty. Therefore, in order to conclude whether or not the death penalty is a just punishment, we must look past all of the philosophical arguments surrounding the death penalty and instead look to the scientific and statistical facts, and determine whether or not our courts are capable of correctly determining whether or not someone is guilty one hundred percent of the time. In order to determine whether or not someone is guilty, the prosecution has to gather evidence against the accused. One of the primary forms of evidence used by the prosecution is eyewitness testimony. Oddly enough, while eyewitness testimony is and has been a key factor in putting people behind bars and on death row, it is well know to be highly inaccurate. Take the case of Jennifer Thompson. Jennifer was a college student in North Carolina when one night, a man broke into her apartment, put a knife to her throat an raped her. After the incident she claimed to have studied he assailants face all throughout the attack so that if she survived she could put him behind bars for the rest of his life.
