Chapter 9, Problem 6. Analyze Ms. Tom's case using all 5 of the elements of the tort of negligence (found in our text) that Ms. Tom will allege. Then, analyze the case using the three defenses to negligence (found in our text) that the store would use to defend itself against Ms.Tom’s allegations. As you write your analysis of this case, assume that your audience does not know anything about the tort of negligence, in order to help you write a thorough analysis. This means you need to: 1. Identify the first element. 2. Explain what this element is. 3. Apply it to the facts of the case. In Ms. Tom’s case to claim for a recovery for injuries occurring in Kresge’s store on November 15, she can claim tort of negligence of five (5) different elements to convey her case. The tort of negligence implies that one party did not live up to a “certain minimal standard of care” expected of the store. The first element of negligence tort Ms. Tom can claim is the Duty. This first element implies that the an “ordinary and reasonable person” failed to live up to this the duty of Kresge’s store to clean up the substances spilled on the ground. Failure to clean up a spilled substance can be viewed as a negligent action and as a result, caused Ms. Tom’s injury.
