The 28 th Amendment that I would like to propose is that of legalizing same sex marriage. This is an issue that has been of some debate for a number of years, especially lately. Currently same sex couples are unable to obtain the same legal rights as male- female couples, as in the majority of the United States they are unable to receive legal recognition for their civil union. This amendment, while not necessarily needed to fall under the title of ‘marriage’ would allow same sex couples to receive the same rights as they would were they to be legally married. This amendment should be passed because all people deserve to have equal rights. It is beside the point whether people feel that same sex relations are “right” or “wrong,” but rather it is of importance to consider the rights that people might receive. It is important that all people be able to have the same rights accessible to them, without having to worry about discrimination of any sort. People opposing this amendment are most likely to argue in terms of whether same sex relations are “right” or wrong.” However, within American government there exists the separation of church and state. Just because one particular group of people believes something is wrong it does not mean that all persons share this belief. Therefore, all people should be entitled to the same rights. If one does not believe that same sex marriage is moral, they need not participate in it and can feel free to exercise their right to free speech to articulate their view. But one should not inhibit the rights of another based on a belief that not all people may share. In addition, the passage of an amendment such as this does not serve to directly harm those opposed to it. The only harm that might exist is that of ‘feeling offended,’ which is inevitable no matter the issue. The likelihood of this amendment being passed is currently unsure. The nation is fairly evenly split on the issue. However, the American people have been becoming more and more open to the idea of same sex marriage. Surely, not long in the future this will be legalized as support continues to grow.

I believe that same sex marriage is a difficult topic. One of the great issues with same sex marriage is the manner in which it is only allowed in certain states. Although it has been considered a state issue, I believe that one component of it that makes the issue difficult is the idea of full faith and credit. Under full faith and credit states are required to recognize certain laws of other states. One of these laws is that of marriage. One does not become “un-married” to his or her spouse upon entering a different state than that they were married in. I believe that same sex marriages should most definitely be
