February 24, 2011 RACIAL INEQUALITIES AND AFFIRMATIVE ACTION - Affirmative Action = efforts to improve the educational and employment opportunities for racial minorities - Affirmative Action and Law o 1978, SC ruled 5-4 that white applicant was wrongly excluded from admission into UC; race-conscious policies okay as long as no quotas o 2003, SC ruled U-Mich admission policy was discriminatory but their law policy was not; ruled okay to use racial policies to make diverse student body o January 2011, appellate court upheld an admissions plan for undergraduates at UT-Austin that takes race into account to encourage diversity - Arguing against affirmative action o Curtis Crawford Promotes overarching moral principle of individual right to nondiscrimination Presented and argued against 5 options for limiting the right for racial discrimination Promotes program for individuals who have suffered specific, oppressive treatment and could clearly demonstrate such treatment in his/her own case; basis of support would be individual injury
