BA 638 Assignment 1.2 Summary of the case An employee of Caterpillar, Inc. was terminated in June, 2002 for excessive personal phone calls, excessive personal internet use, and inadequate job performance. Two years after her termination, the employee filed a lawsuit claiming that she was disciplined and eventually terminated based on her gender and also as retaliation because of her complaints about discrimination (Gates, 2008). Ms. Gates claimed as part of her case that she had been the victim of a glass ceiling discriminatory policy for several years because she had not been able to progress from her long- held position. She cited evidence that she had repeatedly requested transfers or promotions that would have furthered her career development and resulted in higher pay. She claimed that her requests were always denied and that the denial was because of her gender. Gates also accused management of paying higher wages to male employees with similar duties.
