BA 638 Assignment 3.2 Summary of the case Joel Hernandez was employed by Hughes Missile Systems (the petitioner, who was later acquired by Raytheon Corporation) for 25 years. In January, 1991, the petitioner noticed strange behavior and appearance, and required Hernandez to take a drug test according to company policy. The drug test came back positive for cocaine, and Hernandez admitted that he had used cocaine the night before the test. Hernandez was to be fired in accordance with the company’s conduct rules, but he resigned in lieu of discharge. His employee file stated that the reason for his separation was “discharge for personal conduct (quit in lieu of discharge)”. More than two years later, Hernandez applied for a position with the petitioner and stated on his application that he previously worked for the firm. He also attached letters both from his pastor about his active church participation and from an Alcoholics Anonymous counselor about his regular attendance at meetings and his recovery. The application was reviewed by an employee in the Labor Relations department who rejected the application based on the petitioner’s unwritten policy against rehiring employees
