BA 638 Assignment 8.1 (Chapter 14, Question 7) Background Question (from text): A hospital adopted a policy prohibiting employees from (1) soliciting and distributing materials to coworkers during work time and in patient care areas (including areas adjacent to patient units) at any time and (2) soliciting and distributing materials to all nonemployees at any time throughout the entire hospital. Additionally, a nonemployee organizer who was sitting on a bench in front of the hospital waiting for a ride from an employee was ordered off the hospital’s property. ULP charges were filed. What should the Board decide? ( Stanford Hospital and Clinics v. NLRB, 325 F. 3d 334 (D.C. Cir 2003 )) What should the Board decide and why? The legal guidance for this case comes from the National Labor Relations Act, which is administered by the National Labor Relations Board (Walsh, 2010, p. 438). The NLRB is the deciding authority for Unfair Labor Practice charges. There are at least 6 separate restrictions mentioned in this short synopsis, plus the action to remove the organizer from the hospital property. The decision for each restriction / action is listed next, along with the basis for each decision.
